Chicago Tribune: It’s complicated evicting delinquent owners
After months of trying to collect past-due assessments, your community association has a court order to evict the delinquent owner. Now what? You rent out the unit and collect the money until the debt is paid, according to the Illinois Forcible Entry and Detainer Act. Then the owner gets back the unit.
That’s the short answer. In reality, the process is more complicated. And it’s definitely worth pursuing in this age of record-high assessment delinquencies, said association attorney Stuart Fullett of Fullett Rosenlund Anderson PC in Lake Zurich.
Illinois is the only state that gives associations the remedy of temporary possession to satisfy judgments against owners who are in arrears. Associations in other states typically initiate foreclosure proceedings and are awarded permanent possession of the unit. Read more: www.chicagotribune.com
